A recent US federal court decision underscores the benefits to Israeli companies of including forum selection clauses whenever possible in contracts to minimize the risk of litigating in a non-preferred forum. The federal court dismissed a US lawsuit filed by Israeli shareholders against an Israeli-headquartered company. The court found that the shareholders had no applicable forum selection clause supporting their choice of a US court. In addition, the court found that Israel was the most appropriate forum for the claim.
