NLRA Mandatory Posting Requirement Delayed Again
January 2012
Tal Marnin
As we discussed in our September 2011 and October 2011 Alerts, pursuant to a recent regulation by the federal National Labor Relations Board ("NLRB"), most private sector employers, whether or not these employers have union employees, must post notices advising employees of their rights under the federal National Labor Relations Act. The mandatory posting requirement was set to take effect on November 14, 2011 before the NLRB postponed the effective date to January 31, 2012. The NLRB recently announced that it is yet again delaying implementation of this requirement, this time to April 30, 2012. The NLRB agreed to this latest delay at the request of a federal court judge presiding over lawsuits seeking to enjoin the NLRB from implementing this mandatory posting requirement altogether. The NLRB stated that postponing the effective date of the posting requirement is expected to facilitate the resolution of these lawsuits. We will continue to follow these lawsuits for any new developments. If you have any questions regarding the new mandatory posting requirement, please do not hesitate to contact us.
