Petitioners Stolt-Nielsen S.A. and other shipping companies have completed merits briefing of Stolt-Nielsen S.A. v. Animalfeeds International Corp. (No. 08-1198) before the Supreme Court of the United States. The case may pave the way for more class participation in antitrust lawsuits that go to arbitration, according to antitrust specialists. A key issue to be decided in the case is whether class arbitrations can be imposed on companies even when their arbitration clauses are silent on the issue. White & Case partners Christopher M. Curran, J. Mark Gidley, Peter J. Carney and Eric Grannon are cited as counsel to Stolt-Nielsen, assisted by Charles Moore.
