White & Case Lauded for Latin American Arbitration and Restructuring Successes

White & Case earned Latin Lawyer Deal of the Year Awards for two Latin American dispute resolution matters in 2009. White & Case was named in the areas of disputes and restructuring, two of five categories in which Latin Lawyer bestowed its awards.

For the disputes award, Latin Lawyer recognized White & Case for its representation of the Republic of Peru in its victory in Aguaytia v. Peru, a US$150 million energy arbitration before the International Centre for Settlement of Investment Disputes in Washington, DC. In that case, the tribunal ruled unanimously in favor of Peru on a claim regarding an investment in a gas and electricity infrastructure project in Peru. The victory previously was recognized by Chambers Latin America as "a case that established a strong precedent for stability agreements as a means of promoting and protecting foreign investment."

In the second award, Latin Lawyer singled out White & Case for its role in the derivatives restructuring of Mexican company Gruma SAB de CV, one of the largest food products companies in the world. White & Case was recognized for its work as Mexican counsel to the ad hoc creditors committee, a consortium of banks that included Credit Suisse and Deutsche Bank. The restructuring involved the conversion of more than US$1 billion of derivatives claims into medium- and long-term debt for Gruma.
