Practice Experience
Betty is an associate in the dispute resolution practice group. She has over four years’ experience in dispute resolution matters (both international arbitration and litigation) involving banking, company law, defamation, employment, insurance, intellectual property, joint venture and shareholders’ disputes, professional negligence and other general commercial litigation matters.
Matters in which Betty has been involved include:
Representing the Hong Kong subsidiary company of a major European hotel chain in joint venture and intellectual property disputes in China, involving CIETAC arbitration and litigation;
Representing three PRC companies/state-owned enterprises in a potential investment treaty arbitration arising from the revocation of a licence and the expropriation of investors’ interest and rights in a mine;
Representing a Thai listed company in defending a contractual claim in an ICC arbitration arising from disputes concerning a technical service agreement in respect of the re-commissioning of a steel plant;
Representing a German company in defending a contractual claim in an action commenced in Hong Kong, including an application for stay of proceedings on the ground of forum non conveniens;
Representing the provisional liquidators of a Hong Kong company in a winding up proceedings running parallel to a delisting procedure and a resumption of trading of shares application before The Stock Exchange of Hong Kong;
Representing a securities brokerage and financial firm in various debt recovery and contractual disputes in relation to securities margin financing;
Representing a Taiwanese manufacturing company in a dispute concerning breach of an agreement for a PRC joint venture and trademark infringement;
Representing a subsidiary company of a German bank in relation to a proposed application for reduction of capital;
Representing an overseas automobile supplier in contractual claims against individuals and companies in Hong Kong;
Representing the subsidiary company of a global office furniture manufacturing and supply company in numerous contractual and sales of goods disputes;
Representing a shareholder of a Taiwanese food service company in a shareholders’ dispute;
Representing an international group with respect to the internal investigation of a third party’s allegations of breach of its Code of Ethics by one of the group’s regional staff;
Advising a Hong Kong listed group concerning enforcement of a CIETAC arbitral award in Hong Kong and the PRC;
Advising a US apparel company on intellectual property rights enforcement matters in Hong Kong and across Asia;
Advising a European company in relation to domain name and trade mark protection in Hong Kong and the mainland China;
Advising a listed Hong Kong group on employment matters arising from a corporate restructuring;
Advising a multinational bank on a former employee’s complaints concerning the treatment of his entitlement under a share option scheme;
Advising the provisional liquidators of the Hong Kong subsidiary company of an international group on Hong Kong employment matters arising from the liquidation;
Advising multinational corporations on various employment and data privacy issues arising from the companies Code of Conduct and outsourcing arrangements and on various matters including proposed bonus and incentive schemes and termination of employment contracts;
Advising a major technology corporation on the Hong Kong legal framework for redundancy and termination of employment as well as review of ethical human resource issues;
Advising a multinational financial services group on data privacy and confidentiality aspects of outsourcing arrangement;
Advising a European bank on the terms of a draft agreement for terminating the employment contract of a senior member of staff;
Advising a leading electronic and electrical products manufacturer on employment as well as privacy aspects of the company’s information security handbook for its overseas companies;
Advising a company in the fund managing sector on employment law issues arising from a proposed transfer of shares and dividends to a senior employee in Hong Kong;
Advising an oil corporation on employment and other issues arising from a draft employee manual;
Advising a multinational advertising corporation on issues arising from the resignation of senior members of staff, including issues concerning garden leave and restrictive covenants and drafting of termination agreement;
Advising a multinational bank on employment law issues arising from the termination of the employment of a senior staff, including drafting a letter confirming terms of termination; and
Advising a private equity firm on employment law issues arising from transferring an employee to an overseas affiliate company, including drafting a termination letter.
Prior to joining White & Case in August 2006 as an associate, Betty was an assistant solicitor with the Hong Kong office of a leading London-based law firm.
