Practice Experience
Christopher Macchiaroli practices in the Firm’s Litigation Group and represents domestic and foreign clients in complex civil and criminal proceedings in federal and state courts.
Mr. Macchiaroli was an associate in the New York office in 2004 where he represented a major pharmaceutical manufacturer in a monopolization case involving allegations of fraud on the United States Patent and Trademark Office.
For a brief period Mr. Macchiaroli was an associate at a New York commercial litigation boutique firm, where he specialized in representing clients primarily in common law contract, tort, and fiduciary duty claims. In addition to appearing before numerous state and federal courts, Mr. Macchiaroli successfully tried a case on the enforceability of an indemnification agreement, and in the process obtained judgment (plus costs) and statutory interest for his client.
Significant recent experience includes:
Representation of telecommunications company Vertex Telecom, Inc. in a declaratory judgment action brought against XO Communications, Inc. in federal court in Alexandria, Virginia. Mr. Macchiaroli successfully obtained a temporary restraining order and later a preliminary injunction that prohibited XO from terminating services to approximately 2 million customers of Vertex, pending litigation. In addition, Mr. Macchiaroli defeated XO’s motion to dismiss (
see Vertex Telecom, Inc. v. XO Commc’ns
, No. 1:06cv1209 (JCC), 2006 WL 3746142 (E.D. Va. Dec. 14, 2006)), and obtained dismissal with prejudice of certain XO counterclaims;
Trial counsel for a parcel tanker company in an unprecedented case brought against the company after the company had obtained amnesty from the Department of Justice and provided critical, incriminating evidence against its co-conspirators. After a three-week evidentiary hearing, a federal district court in Philadelphia dismissed the indictment of the company and two of its executives, thereby enforcing the Amnesty Agreement;
Counsel to Chinese glass manufacturer in multimillion dollar nationwide class action in the Southern District of Illinois. The manufacturer was subsequently dismissed from the action given the failure of the Third-Party Plaintiffs to make a prima facie showing of personal jurisdiction.
See Martha Stewart Living Omnimedia v. Xinyi Group (Glass) Co., Ltd
., No. 05-520 (GPM), 2008 WL 3992687 (S.D. Ill. Aug. 22, 2008).
Counsel to Honduras company seeking to enforce a foreign arbitral award in the Eastern District of Virginia.
Currently, Mr. Macchiaroli is counsel to a pharmaceutical company in defense of civil antitrust claims before the Multidistrict Litigation Panel in the U.S. District Court for the District of New Jersey, and counsel to Canadian wood producers in multi-defendant products liability action in Illinois state court.
Mr. Macchiaroli also currently represents a client
