Practice Experience
Mr. Shore has been with White & Case since 1992 and is a member of the commercial litigation practice group. Mr. Shore specializes in trials of contract and other complex business disputes relating largely to debtor/creditor relations.

Mr. Shore has tried jury and bench trials in federal and state courts as well as before arbitral and administrative bodies involving shareholder agreements, bank finance agreements, intercreditor agreements, derivative instruments and structured financings.  Mr. Shore has been lead trial counsel in more than a dozen of these disputes.

Recently, Mr. Shore acted as trial and appellate counsel for the ad hoc Committee of Arahova Noteholders, a committee of bondholders in the Adelphia bankruptcy cases pending in New York.  Described as among the most complex and contentious bankruptcy cases ever litigated, the Adelphia disputes involved the allocation of over US $17 billion in assets to creditors of estates involved in one of the most significant and wide-ranging corporate frauds in US history. Following extended trials of various claim allowance and asset allocation disputes, Mr. Shore and his trial team were able to secure an additional US$2 billion of distributions for  Arahova bondholders, resulting in a full recovery for the Firm's clients.

Prior to the Adelphia engagement, Mr. Shore acted as lead bankruptcy litigation counsel for Mirant Corporation and was responsible for conducting all bankruptcy litigation and managing outside litigation relating to Mirant's bankruptcy proceedings in Fort Worth, Texas. As litigation counsel, Mr. Shore developed and implemented a series of custom claim, trial and estimation procedures to resolve over US$260 billion in disputed claims filed against Mirant.  That process resulted in the disallowance or material impairment of approximately US$250 billion in filed claims. Mr. Shore was also litigation counsel in the trials of numerous of Mirant's contested matters and adversary proceedings in courts throughout the US, including Mirant's valuation trial and confirmation hearings and its significant appeals to the Fifth Circuit Court of Appeals. The Mirant engagement was a critical component of the Firm being named the 2006 IFLR "Restructuring Team of the Year."

Other of Mr. Shore's engagements have included:
  • Defending various financial institutions against "lender liability" claims, including obtaining the dismissal of all claims against an agent bank for disgorgement of US$100 million in loan repayments on fraudulent conveyance and constructive trust grounds;
  • Representing equity participants and lenders in domestic and foreign project finance workouts and litigations concerning defaulted credit agreements terminations of collateralized contracts;
  • Representing non-utility generators in complex bankruptcy cases such as Enron and Pacific Gas & Electric;
  • Acting as bankruptcy litigation counsel for debtors in the communications and cable industries; and
  • Representing the agent lenders in a multi-jurisdictional dispute involving the collection of US$675 million in defaulted debt related to residential real estate development projects.

In 2007, Mr. Shore undertook material litigation engagements in many of the largest and most prominent pending bankruptcy cases in the US, including those of Dana Corporation, Delphi Corporation, Delta Airlines, Salander O'Reilly Galleries and Solutia, Inc.

Mr. Shore is currently lead counsel for Old Ladder Litigation Company, a litigation trust established in the bankruptcy case of Werner Ladder, in efforts to recover in excess of US$1 billion from more than 200 defendants.
