Practice Experience
Frank L. Eaton advises on issues relating to bankruptcies and restructurings.  His practice includes representation of debtors, creditors, and investors in Chapter 11 cases, out-of-court workouts and restructurings, and other proceedings involving a variety of industries such as retail, manufacturing, real estate, cable television, utilities, health care and transportation.

Mr. Eaton has been involved in the representation of such debtors as a major New York-based department store retailer during its Chapter 11 case, which culminated in its merger with a major Ohio-based department store retailer under a plan of reorganization; a major apparel manufacturer during its successful reorganization and the spin-off of one of its affiliates; a major catalog showroom retailer during its successful reorganization; a national retailer of cellular telephone services and accessories; and a Canadian steel company in its ancillary proceeding in the United States and various aspects of its successful Canadian insolvency proceeding, as well as its subsequent acquisition of an American steel company in bankruptcy.

Mr. Eaton has been involved in every major aspect of these cases, including debtor-in-possession financing, asset sales, plan negotiations and confirmations, and complex bankruptcy court litigation.

He has been involved in numerous representations of creditors, including the Creditors Committee in the Chapter 11 case of a large textile manufacturer; the purchaser of lease designation rights in the Chapter 11 case of a major discount retailer; the purchaser of the solar panel division of a heritage solar panel manufacturer in its Chapter 11 case; a bank group in the involuntary bankruptcy of a co-generation power plant; a major secured creditor in the Chapter 11 liquidation of a co-generation power plant, which involved the settlement of complex litigation with a large New York State utility under a liquidating plan; and a co-defendant, non-debtor manufacturer in the Chapter 11 case of a breast implant manufacturer.  He has also represented the Chapter 11 Trustee appointed in two related single-asset real estate cases.
