"Get a Life"—Trademarks in a Virtual World

Scores of "virtual worlds" are created and populated each year. Second Life, IMVU, Farmville, MyTown and Mafia Wars are just a few in a market that could reach US$2.6 billion next year. Many of these virtual worlds have their own economies and offer virtual goods and services using real-world trademarks for purchase with real money. As in the real world, virtual worlds present fertile ground for trademark opportunities as well as abuse.

What can a trademark owner do if its marks are used without authorization in the virtual world?

This seminar will provide an overview of virtual worlds and how trademark law applies in this context, including trademark infringement and dilution claims and defenses. The seminar will discuss how trademark owners are finding ways to use virtual worlds as new marketing tools to increase brand awareness. The panelists will also examine how game players themselves are creating their own unique content and in-game "brands" for which they are also seeking protection.
