Practice Experience
Heidi Keefe is an Intellectual Property partner in White & Case's Palo Alto office.  She is a registered patent attorney who represents clients in a variety of high-stakes patent trials before juries and judges.  Her background in Astrophysics makes her uniquely qualified to easily pick up and understand a variety of technical disciplines, from software to medical devices.  Ms. Keefe has frequently been recognized as a leading lawyer, including her recent recognition as one of the "Top 20 Lawyers in California Under the Age of 40," (for 2009) by the editors of the San Francisco Daily Journal and the Los Angeles Daily Journal.  She was also recognized as one of "The Bay Area's Best Lawyers" by Bay Area Lawyer magazine.

Ms. Keefe is a member of the Founding Committee of White & Case LLP's Women's Network, an organization focused on providing female lawyers in the firm with access to role models, as well as leadership, business development, mentoring, and peer support opportunities. 

Prior to joining White & Case, Ms. Keefe was a partner at another leading international law firm where she was co-chair of the firm's training program.  She also served as a law clerk to the California Legislative Counsel Bureau and a Judicial Extern to the Honorable Conrad Cox and the Honorable James King of the Mendocino County Superior Courts.

Notable Engagements:
  • Facebook, Inc. In Cross-Atlantic Capital Partners, Inc. v. Facebook, Inc. (E.D. Pa.) and Leader Technologies, Inc. v. Facebook, Inc. (D. Del.), Ms. Keefe is defending Facebook in two patent infringement suits relating generally to social networking and web technologies.
  • Oplink Communications, Inc.  In Oplink Communications, Inc. v. O-Net Communications (Shenzhen) Ltd., Ms. Keefe represented Oplink in a patent infringement, trade secret misappropriation and breach of contract case relating to optical telecommunications networks.
  • IMAX v. In-Three.  Ms. Keefe represents In-Three, Inc. in a patent dispute involving In-Three's technology for converting two dimensional movies into three dimensional movies.  In-Three successfully defeated IMAX's motion for preliminary injunction in the Central District of California, freeing In-Three to proceed towards its release of a 3D version of a major motion picture.
  • DVD Copy Control Association v. Kaleidescape.  Ms. Keefe represents the DVD Copy Control Association in its efforts to combat unauthorized copying of CSS protected data.
  • Affymetrix.  Ms. Keefe represents Affymetrix in a variety of matters in the US and abroad.  Ms. Keefe has defended the GeneChip® product from patent infringement allegations and enforced Affymetrix's GeneChip® patents against infringers in California, Delaware, and the United Kingdom.
  • BNP Paribas.  Ms. Keefe represents the bank in the United States regarding intellectual property disputes.
  • Covidien Ltd. (formerly Tyco Medical).  Ms. Keefe represents Covidien on a broad variety of patent counseling regarding its medical device products and technologies.
  • Microsoft Corporation.  Ms. Keefe represented Microsoft in a number of high stakes patent litigations, including Reiffin v. Microsoft (patent suit involving multi-threading technology) and Intertrust v. Microsoft (patent suit involving a variety of technologies related to security and digital rights management).
  • eBay Inc.  Ms. Keefe represented eBay and PayPal in various patent infringement matters involving internet software patents, including Tumbleweed v. eBay which focused on Internet banking software.
  • Megadyne Medical Products.  Ms. Keefe represented Megadyne as plaintiff in a number of patent actions in the Utah District Court. 
  • Aureal Semiconductor.  Ms. Keefe obtained a unanimous jury verdict of non-infringement of Aureal's 3-D audio sound card technology in Creative Technology, Ltd. v. Aureal Semiconductor, Inc.  This case was selected as one of the "Top 10 Defense Verdicts of 1999" by The National Law Journal.
  • Hoffmann-La Roche, Inc.  Ms. Keefe assisted an international pharmaceutical company and its subsidiary in protecting Nobel Prize-winning DNA replication patents in Hoffmann-La Roche, Inc. v. Promega Corporation.
  • Hon Hai Precision Industry Co., Ltd. and Foxconn Corporation.  Ms. Keefe represented Foxconn and Hon-Hai in a patent infringement suit in the Northern District of California involving seven patents.
  • Nanya Technology Corp.  Ms. Keefe represented Nanya Technologies Corporation in Renesas Technology v. Nanya, a seven patent case relating to design features of DRAM semiconductors.
