The European Commission published its Guidance Paper on the application of Article 82 of the EC Treaty to exclusionary abuses on 3 December 2008. The Guidance Paper follows the publication in December 2005 by DG-COMP of a Staff Discussion Paper which suggested possible methodologies for the assessment of some of the most common exclusionary abusive practices, such as refusal to supply, tying, and rebates.
