Practice Experience
Joshua Hartshorn is an associate in the Firm's Americas Banking and Energy, Infrastructure, Project and Asset Finance groups. His primary practice areas include bank and project finance, equipment leasing and finance transactions and general corporate work, with a focus in Latin America.
Significant recent experience includes:
- Representation of Empresa Generadora de Electricidad Haina, S.A. as sponsor in connection with the development and construction of a wind farm located in Juancho Los Cocos, Dominican Republic;
- Representation of Braskem Idesa S.A.P.I. in the development, procurement, construction and financing of its Etileno XXI olefins (ethylene and polyethylene) complex in Veracruz, Mexico;
- Representation of various aircraft management companies in the financing, sale and leasing of numerous aircraft to various operators in Russia, Mexico, Argentina, France, the United States of America, Finland, Germany, United Kingdom, Kenya, and Luxembourg;
- Representation of an airline in an export credit agency supported secured aircraft financing of 10 aircraft;
- Representation of HSBC Bank USA, National Association, as Administrative Agent, in a $1,000,000,000 senior syndicated bridge loan to Banco de Bogotá S.A.;
- Representation of Standard Chartered Bank, as administrative agent and lead arranger, in connection with a US$135 million senior unsecured term loan facility for a Peruvian development and investment bank;
- Representation of Corporación Andina de Fomento (CAF), as guarantor, of private notes issued by Nacional Financiera, S.N.C., Institución de Banca de Desarrollo, in connection with the securitization and project financing of the modernization of the Instituto de la Función Registral del Estado de Mexico. This transaction was selected as "2010 Best Structured Financing Deal" and "2010 Best Innovation Deal" by LatinFinance magazine and as "2010 Latin America Domestic Currency Bond of the Year" by International Financing Review magazine;
- Representation of an airline in the sale-leaseback of an aircraft subject to an export credit agency supported secured aircraft financing;
- Representation of Mexichem SAB de CV, a major Mexican chemical producer, on its acquisition of the fluorochemical business division of UK-based INEOS Holdings Limited for US$350 million;
- Representation of a syndicate of banks including BNP Paribas, Natixis, Société Générale, Calyon and Crédit Industriel et Commercial in providing a US$586 million credit facility to Globalstar, Inc., a leading provider of mobile satellite voice and data services, with credit support from Coface, the French export credit agency; and
- Representation of Durango McKinley Paper Company, as seller, in the sale of its corrugated box converting plant in Mesquite, Texas.
