Practice Experience
Jon Hawk is a litigator, dividing his practice between commercial litigation and employment law. His commercial litigation practice focuses on contractual disputes and business torts, and often involves alternative dispute resolution proceedings. Mr. Hawk's most recent commercial litigation matters include:
- Defense of an individual founder, officer, and shareholder of multiple entities against alter ego claims. An individual plaintiff sued the client and seven companies, claiming he was wrongfully denied equity interests in those entities and that the client operated each of the entities as his alter egos. The Court granted summary judgment in the client's favor on all sixteen alter ego claims against him;
- Defense of a corporate owner of a commercial building leased to tenants operating data centers against claims that the client, during lease negotiations, fraudulently misrepresented proposed lease terms governing the plaintiff's permissible use of certain building critical facilities. The plaintiff sought to terminate the lease;
- Representation of a South American apparel manufacturer asserting a claim for breach of contract against a corporate wholesaler of industrial machinery. The case resulted in a complete judgment for the client; and
- Representation of a South American meat packing corporation asserting claims against a wholesale food distribution corporation for, among other things, breach of contract and breach of the covenant of good faith and fair dealing.
Mr. Hawk's employment practice emphasizes the defense of employers against claims of vicarious liability and negligent hiring, supervision, and retention. He also regularly counsels employers on day-to-day employment relations, including employee investigations, policy and procedure enforcement, individual employee discipline, and termination issues.
Mr. Hawk is active in pro bono matters and, most recently, worked with the Alliance For Children's Rights to obtain in excess of $15,000 in retroactive funding from the County of Los Angeles for a foster child and his adoptive family.
Prior to joining White & Case, Mr. Hawk clerked for the San Francisco District Attorney's Office where he conducted hearings and engaged in extensive motion practice.
