Practice Experience
Ms. Martin is a litigator with a focus on labor and employment law. She has experience representing employers in both class and single plaintiff actions, including wage and hour, wrongful termination, harassment, and negligent hiring lawsuits. She also advises employers with respect to wage and hour laws, revisions to employee handbooks and policies, severance agreements, employee classifications, and dispute avoidance and resolution.
Ms. Martin’s experience includes strategizing and conducting discovery, taking and defending depositions, preparing mediation, trial and appellate briefs, oral argument, preparing cases and witnesses for trial, and trial as a second-chair. She has also conducted wage and hour audits and stock option backdating and foreign corrupt practices act investigations.
Among Ms. Martin’s most significant recent experience is the important role she plays in defending a California employer in a class action lawsuit alleging that the employer failed to pay its 28,000 California employees overtime wages, failed to provide meal breaks, failed to provide rest breaks, and committed other alleged wage and hour violations.
Ms. Martin’s recent experience has included:
Defending a non-profit religious corporation against claims brought by five former employees alleging, among other things, wrongful termination, failure to pay overtime, and negligent hiring. Ms. Martin prepared a successful demurrer to several claims in the lawsuit, resulting in a favorable settlement for the client.
Defending a corporation in a class and collective action lawsuit alleging misclassification of assistant managers as exempt executives under the Fair Labor Standards Act and state labor laws.
Representation of a property owner in a breach of contract action for the sale of land in Santa Barbara, CA. Ms. Martin participated in all aspects of the case through trial and the pending appellate proceedings.
Representation of a pro bono client in a fraudulent conveyance action whereby Ms. Martin successfully restored the client on title to the property.
Member of a team conducting an internal investigation for multiple segments of a multi-national corporation with extensive overseas operations regarding possible Foreign Corrupt Practices Act violations.
