Practice Experience
Megan DePasquale is an associate in White and Case's Global Competition and Commercial Litigation Groups. She concentrates on complex commercial litigation and counseling in the areas of antitrust, trade regulation, and intellectual property.
Ms. DePasquale regularly represents clients in the financial services and pharmaceutical industries.
Representative cases include the following:
- Represented Experian Information Solutions, Inc. in an action brought by Fair Isaac Corporation against the three major U.S. credit reporting agencies and their joint venture. Obtained a jury verdict on claims involving allegations of unfair competition and trademark infringement in the sale of credit risk scoring services, and on a counterclaim that Fair Isaac committed fraud on the U.S. Patent and Trademark Office in obtaining its registration for the trademark-in-suit. Obtained dismissal of all antitrust and false advertising claims on summary judgment.
- Successfully defended a leading global pharmaceutical manufacturer in preliminary injunction proceedings challenging FDA approval of a complex drug.
- Represented client in a JAMS arbitration proceeding involving a contractual dispute under a distributor agreement.
- Provided counseling to the American Society of Composers, Authors and Publishers on various issues relating to its membership agreements and the duties of its Board.
- Assisted a global manufacturing company in connection with a worldwide investigation for fraud and violations of the Foreign Corrupt Practices Act.
- Represented Visa in litigation in which MasterCard challenged a deal between FIFA and our client to sponsor FIFA events, including the World Cup tournament.
Pro bono activities include the following:
- Representing indigent disabled children and their families in educational disputes with their local school districts over the appropriate educational placement and services to be provided to the child under federal and state law.
- Currently representing putative class of kindergarten students in J.T. o/b/o A.T. v. Dumont Public Schools, a special education action in the District of New Jersey.
Ms. DePasquale graduated from Rutgers school of Law in 2006. She was a member of the Rutgers Moot Court Oral Advocacy Team and an editor of the Rutgers Law Review, which published her student Note: "Fetal Personhood After the Unborn Victims of Violence Act," 58 Rutgers L. Rev. 553 (2006). Ms. DePasquale also volunteered with the Rutgers Domestic Violence Advocacy Program, which provides domestic violence litigants with an overview of the legal process and assists them in obtaining Temporary and Final Restraining Orders.
