Practice Experience
Mark Lambert is a partner in White & Case's Intellectual Property and Litigation Groups.
Mr. Lambert's intellectual property litigation practice focuses on representing clients in a variety of different industries, including foreign and domestic manufacturers of software and hardware, in matters involving trade secret, patent, and copyright claims. Mr. Lambert’s experience involves matters in a variety of computer science and computer engineering disciplines, including routing and switching gear; digital rights management; internet hyperlinking technologies; and network architecture caching technologies.
Mr. Lambert also has extensive experience representing foreign and domestic companies in disputes over technology licensing, unfair competition, and business torts. He was a key member of a trial team that won verdicts for a software manufacturer in a case involving trade secret, copyright, and Lanham Act false advertising claims, as well as unfair competition and other business torts.
Mr. Lambert earned his J.D. in 1998 from the University of California, Hastings College of the Law. While at Hastings, he served as an executive editor on The Hastings International and Comparative Law Review, and as an extern to the Honorable A. James Robertson, II of the Superior Court for the City and County of San Francisco.

Nortel Networks, et al. v. Foundry Networks D. Mass
. Represented Foundry D. Mass. in a patent infringement case involving technologies that concern routing/switching gear.
Trade Secrets:
ABB Power T&D Company v. Alstom Esca
. Represented Alstome Esca in a trade secret case that involved electric power/grid management and commodities trading software.
Applied Materials v. LTD Ceramics.
Represented Applied Materials, Inc., in a trade secret matter concerning semiconductor manufacturing tool technologies.

RealNetworks, Inc., et al. v. DVD Copy Control Association, Inc. et al.
(N.D. Cal.) and
DVD Copy Control Association, Inc. v. Kaleidescape, Inc.
(Santa Clara Sup. Ct.), Mark represents the DVD CCA in two separate actions alleging breach of the technology license that covers use of the Content Scramble System (CSS) technology that is used to prevent copying of motion picture DVDs. Both cases are pending.
Represented leading supplier of technology to the mortgage lending industry by defeating copyright, trade dress and trade mark claims brought by competitor.
Technology/IP Licensing:
Represented the DVD Copy Control Association in breach of contract dispute with Kaleidescape, Inc.
VIZ Media v. Ventura Distribution, Ventura Home Entertainment
. Represented VIZ in a contract dispute over distribution agreement concerning anime DVDs.
