White & Case partner Dan Hamilton was quoted on the subject of proposed reform to insolvency regulation in a recent article in Creditflux magazine.

Dan Hamilton, who is also co-chair of the EHYA's European insolvency reform committee says: "In UK administration, a lot of people can be squeezed because valuation is done on the basis of short-term liquidation. We think that is not the right test where one set of lenders take an ongoing stake in the business. It wipes out a lot of junior investors, even though the restructuring is done on the understanding that the company is worth more in the future."
