Bailout Package’s Legal Riddles Abound

As reported in The National Law Journal, clients are asking law firms how participating in the Emergency Economic Stabilization Act will impact them.  Duane Wall, head of White & Case’s Bank Advisory Practice was quoted on why companies may question their participation in the bailout.

"Each of these programs comes with some controls," he said "You're really going to have to decide: Do you need the assistance, and do you need it sufficiently to accept the conditions that have been imposed?"

Clients may also worry about the “increased government oversight” involved in some of the bailout programs.

"I don't think a lot of people envy the idea of being called up to Capitol Hill to one of [Representative Henry] Waxman's oversight hearings," Wall said.
