Institutional Arbitration Lags Behind in India

Global Arbitration Review reported on the International Federation of Commercial Arbitration Institutions Conference that took place on October 19 and 20 in New Delhi, India. Among the attendees was India's law & justice minister, who expressed a need to develop institutional arbitration in India. Many practitioners agreed, among them Aloke Ray, a partner in the International Arbitration Practice at White & Case in London.
"Over 90 percent of Indian arbitrations are ad hoc," he said, "and this is largely due to the lack of a credible arbitral institution in India with a proven track record of effective case administration. The establishment of an internationally recognized arbitral institution within India would fill this gap and, in time, hopefully assist in improving the speed, predictability and finality of Indian arbitrations."
