Practice Experience
Paul de Gruchy joined White & Case as a trainee in 2003, qualifying into the Dispute Resolution group in 2005. Working primarily with large corporate and banking clients, he has experience of international arbitration, commercial litigation and regulatory investigations. Prior to joining White & Case, Paul worked in Madrid and Lisbon for two years as a business analyst in the telecoms division of an international consulting company.

In the field of dispute resolution, recent examples of Paul’s experience include:
  • Advising a syndicate of investment banks in relation to a dispute concerning the refusal of a hedge fund to honor its commitment to participate in the syndication of debt facilities provided in connection with the purchase of a German media group by private equity funds; 
  • Assisting in internal investigations into suspected breaches of the United States Foreign Corrupt Practices Act; 
  • Representing a global construction company in an UNCITRAL arbitration arising from disputes relating to over 200 claims on a civil works contract for a hydro-electric project in South America. The claims relate to a collapsed tunnel, unforeseen ground conditions and delay and disruption arising from civil unrest and other causes; 
  • Representing a joint venture between a North African government agency and two multi-national oil companies as the respondents in a US$100-plus million ICC arbitration in Geneva, arising out of a dispute with the main contractor on the construction of a gas extraction plant in North Africa; 
  • Acting in an ICC arbitration for a Dutch cable company in dispute with a joint venture between two Hollywood studios. The arbitration raised complex issues of competition and cross border insolvency law; 
  • Acting for Merrill Lynch Capital Services in its US$9 million claim against Netia, a Polish fixed line telephone company, on an interest rate swap contract. The case raised issues of Polish insolvency law and the recognition that the English Court would give it; and 
  • High profile High Court litigation for three banks in relation to their multi-million pound investment in a major group of companies.
