White & Case Claims Significant Victory in Sodium Chlorate Cartel Case
Third victory relating to cartel matters in four months

London, Brussels, October 25, 2011 ... Global law firm White & Case LLP has today achieved a significant victory for its clients Aragonesas and Uralita as the European Union (EU) General Court annulled Eur9.9 million of fines imposed for the Aragonesas' part in a sodium chlorate cartel.

"This is the third victory of this kind for the Firm in four months," said White & Case partner Pontus Lindfelt. "The General Court is clearly no longer looking at these cases in isolation; they are looking more seriously at a number of these cases and evaluating more rigorously how the evidence is assessed."

In the case against Spanish company Aragonesas and its parent company Uralita, the court criticised the evidence as insufficiently precise and conclusive and did not find a firm conviction that Aragonesas participated in a cartel through the entire period in question. As a result, all fines levied were annulled.

In July, the General Court ruled in favour of White & Case client Toshiba Corporation for its alleged participation in a cartel for gas insulated switchgear. Earlier the same month, the General Court, in the high profile synthetic rubber cartel case against clients Unipetrol a.s. and Synthos Kralupy a.s. (formerly, Kaučuk a.s.), annulled all fines against the company.

Uralita and Aragonesas were represented in the Commission investigation by White & Case partners Pontus Lindfelt and Kai Struckmann. Their case was argued before the General Court by White & Case partners Ian Forrester Q.C. and Kai Struckmann, who are based in Brussels.
