Climate Change Initiative Launched at White & Case

New York, Miami, Brussels, November 24, 2008 ... Global law firm White & Case LLP today announced the launch of a Climate Change Initiative to help companies meet the economic and legal ramifications of global climate change policy, regulation and legislation.  The initiative spans White & Case offices worldwide and integrates numerous practices, including environmental, litigation, project finance, energy, investment funds and securities.

Climate change has become one of the defining issues of our time.   In recent years, there has been a steady increase in the regulation of greenhouse gas emissions nationally and across borders.  The European Union has been at the forefront, as it was the first to impose legislation to reduce greenhouse gases through a market-based cap-and-trade system, which allows companies to ease some of the compliance cost by buying and selling emissions credits. Other countries are following suit.  In the United States, President-elect Obama has indicated he is in favor of establishing a cap-and-trade system and it is widely expected that cap-and-trade legislation will be taken up by the next Congress.  

"The issue is not whether there will be additional regulation of greenhouse gas emissions but when and in what form," said Neal McAliley, partner in White & Case's Environmental Practice in Miami who is leading the initiative.  "For many companies, the new laws will pose significant challenges; for others, opportunities.  Either way, companies will need help tracking and complying with new rules and regulations and understanding what effect they will have on their businesses and shareholders."  

This new initiative integrates the Firm's already-significant efforts in this area.  White & Case has a long history of work in the area of greenhouse gas regulation, including:
  • Advising clients on more than 85 renewable energy projects around the globe, including wind, solar, geothermal and hydroelectric. 
  • Counseling companies on European and North American emissions trading documentation, including those based on standards prepared by the International Swaps and Derivatives Association, European Federation of Energy Traders and International Emissions Trading Association.
  • Advising clients on two continents on the international trade implications of varying emission-reduction requirements under the Kyoto Protocol and the European Union Emissions Trading Scheme. 
  • Counseling clients on several continents regarding the allocation, sale and monetizing of emissions credits in connection with the financing of infrastructure projects.
  • Representing clients in disputes related to climate change issues, including the sale of emission reduction agreements and the adequacy of governmental analyses of climate change issues and the allocation of emission permits.
