White & Case Wins Jury Verdict for Experian in Major Trademark Case

November 30, 2009 ... Global law firm White & Case LLP successfully represented Experian Information Solutions, Inc., in a major trademark lawsuit brought by Fair Isaac Corp. (FICO).
A jury in the US District Court for the District of Minnesota affirmed Experian's right to continue marketing its credit scoring VantageScore and PLUS Score services, rejecting FICO's claim that those services infringed FICO's alleged trademark rights in the scoring range 300-850. The jury also found that FICO had obtained its trademark registration by committing fraud on the US Patent and Trademark Office.
The jury verdict follows a July 2009 decision by US District Judge Ann Montgomery granting Experian's motion for summary judgment and dismissing FICO's antitrust and false advertising claims. The trademark verdict removes the final remaining claim in FICO's case, and all claims have now been resolved in Experian's favor.
