Regulatory Developments: The CFTC Adopts Final Entity Definitions

The CFTC held an open meeting on Wednesday, April 18, 2012, adopting two final rules and an interim final rule: (1) Final Rules Further Defining "Swap Dealer," "Security-Based Swap Dealer," "Major Swap Participant," "Major Security-Based Swap Participant," and "Eligible Contract Participant" ("Final Rule on Entity Definitions") and (2) Final and Interim Final Rules on Commodity Options. The Final Rule on Entity Definitions were also adopted on Wednesday by the SEC.
