Ross Elfand is an associate in White and Case's Global Competition and Commercial Litigation Groups. He concentrates on complex civil and criminal commercial litigation and counseling in the areas of antitrust, trade regulation, and intellectual property.

Representative cases include the following:

Civil Antitrust Matters
  • Representing a leading credit reporting agency in an action brought by the dominant provider of consumer credit risk scoring services against the three major US credit reporting agencies. The action includes claims under the antitrust, trademark and false advertising laws.

Criminal Antitrust Matters
  • Defended a global company in a criminal price fixing investigation brought by the Department of Justice, Antitrust Division.

General Commercial Litigation
  • Representing a leading generic pharmaceutical manufacturer in an action brought by the branded pharmaceutical company.
  • Representing a pharmaceutical manufacturer in proceedings before the Federal Trade Commission.
  • Provided counseling to a financial services company regarding recovery of a loan made to a bankrupt hedge fund.

Mergers & Acquisitions
  • Provided counseling to a leading credit services company on Hart-Scott-Rodino Act filing for one of the largest IPO's in history.

Antitrust Counseling
  • Provided counseling to a media distribution company regarding potential tying claims against movie studio and production companies.
  • Provided counseling to a leading pharmaceutical company regarding the antitrust implications of a joint venture.
  • Provided counseling to a leading electronics manufacturer regarding the implications of changes in resale price maintenance law.
  • Provided counseling to merging companies regarding the implications of the Tunney Act Public Comments Requirement.

Pro Bono Work

As part of the Firm's pro bono efforts, Mr. Elfand participated in the Firm's externship program with inMotion, Inc., where he represented and counseled indigent women who were victims of domestic violence in matrimonial and family law matters. During the three month externship, Mr. Elfand served as lead counsel on numerous cases at the same time and appeared in court on a weekly basis.
