Mr. Gandesha represents clients with respect to a wide variety of intellectual property and commercial litigation matters, including complex patent, trade secret, copyright and antitrust litigations. Mr. Gandesha also advises and counsels clients with respect to data protection and privacy issues, including cross-border transfers of personal data, security breach notification issues, Internet and email marketing, and Internet privacy policies. Mr. Gandesha has represented and advised national and multinational clients in the pharmaceutical, oil, telecommunications, IT, consumer health, entertainment and financial services industries.

Mr. Gandesha’s recent cases have included the following:

• Representation of a generic drug manufacturer in multiple state and federal actions alleging false claims act, common law fraud, and consumer protection claims based on allegations that drug manufacturers reported inaccurate pricing benchmarks, which allegedly caused state Medicaid agencies to overpay for prescription drugs provided to Medicaid beneficiaries;
• Representation of a major national oil company in a putative class action alleging price fixing of refined petroleum products relating to OPEC;
• Representation of a major pharmaceutical manufacturer in a monopolization case involving allegations of fraud on the United States Patent Office;
• Representation of a major pharmaceutical manufacturer in a trade secret misappropriation matter before the United States International Trade Commission concerning alleged theft of bacterial strains;
• Representation of landline and wireless telephone companies in multi-party federal patent infringement actions concerning international call-blocking technology; and
• Representation of a performing rights society in litigation concerning copyright issues relating to music on the Internet.
