Practice Experience
Sam J. Alberts leads the Washington, DC Financial Restructuring and Insolvency Group. Mr. Alberts has significant experience in complex domestic bankruptcies and cross-border business restructurings. He has represented debtors, creditors, committees, trustees, lenders, foreign entities, sovereigns, landlords, financing companies and purchasers of distressed assets in all phases of reorganization.
Mr. Alberts has represented parties in some of the largest cases in the United States and around the world. Among other matters, he is representing several creditors in various Lehman Brothers cases pending in the United States and Europe, The International Finance Corporation (IFC) on a debt restructuring of an airport in Costa Rica, a Russian company that is the largest creditor in related bankruptcy cases pending in Colorado and Switzerland, and several European space agencies on a satellite company in bankruptcy proceedings in Washington, DC and the British Virgin Islands. Mr. Alberts was part of the team that represented the debtor in the Mirant Chapter 11 cases, one of the largest restructurings ever filed in the United States.
Mr. Alberts also has particular experience in distressed health care systems and committees. He currently represents the Official Committee of Unsecured Creditors in the Hospital Partners of America Chapter 11 cases pending in Delaware, he serves as the post-confirmation trustee of the successfully-reorganized Doctors Community Healthcare Corporation and five affiliate hospitals (and served as counsel to the Official Committee of Unsecured Creditors in those Chapter 11 cases pre-confirmation), and is counsel to the Official Committee of Unsecured Creditors in MCSi, Inc., pending in Baltimore, Maryland. He has represented the debtors in the Response Oncology Inc., Chapter 11 cases in the Western District of Tennessee, the Official Committee of Unsecured Creditors in the Greater Southeast Community Hospital Chapter 11 cases in Washington, DC, and the Commonwealth of Pennsylvania in the AHERF Chapter 11 bankruptcy cases in Pittsburgh, Pennsylvania (which was one of the largest health care cases ever filed).
Mr. Alberts is an experienced litigator with first-chair trial experience in a variety of business-related matters in state and federal courts. He argued a bankruptcy case of first impression concerning creditor rights in the Ninth Circuit in
Glass v. Hitt
, 60 F.3d 363 (9th Cir. 1995).
A well respected authority on these issues, Mr. Alberts has been quoted in leading publications including the
