Overview

Gero von Jhering is a partner in the Firm's Global Commercial Litigation Practice. Recognized by Legal 500 (Germany) and Handelsblatt (Best Lawyers), he specializes in Commercial Litigation regarding all areas of business and commercial law, with a focus on multijurisdictional litigation, trade law, contract law, insolvency law, competition law and corporate law. His varied commercial litigation background enables him to offer clients robust and knowledgeable representation across a broad range of matters.

Furthermore, Gero von Jhering has gained significant experience in complex negotiations and focuses on a functional and economical approach to find reliable outcomes in the client's interest. His practice also extends to advising clients on issues related to contract drafting, enforcement and interpretation, as well as counseling clients in connection with pre-dispute strategy and settlement negotiations.

In 2017, Gero von Jhering was seconded to the New York office of White & Case and during his secondment he worked in the department of Glenn Kurtz (Global Chair of Commercial Litigation at White & Case).

Before joining White & Case Gero von Jhering worked as a research assistant and assistant lecturer at the Seminar for Civil Procedural Law. He wrote his doctoral thesis (Dr iur) as a scholar of the postgraduate program of the Universities of Hamburg, Valencia, Cambridge, Wroclaw as well as the Bucerius Law School (Hamburg) and the Max Planck Institute for Comparative and International Private Law.

Experience

Litigation related to Restructuring and Insolvency

Representing clients in various insolvency proceedings related to several industries – including energy (Conergy, German Pellets, TelDaFax, Innowatio), aviation (Air Berlin, Hamburg Airways), sports (Kickers Offenbach), department stores & consumer goods (Bonita, Hertie, Beate Uhse). These cases involve, among other things, cross-border insolvency claims, manager's liability claims and post-M&A disputes.

Defending insolvency administrators against professional negligence claims.

Representing creditors in insolvency and restructuring proceedings.

Contract Disputes & Contract Drafting and Negotiation

Representing numerous national and international companies with regard to contract drafting and dispute resolution advice as well as commercial disputes, such as K+S Group in complex commercial matters including contract and insurance disputes.

Corporate and Shareholder Litigation

Representing shareholders, board members, managers and directors in multiple disputes, in particular in complex multi-stakeholder actions. This includes shareholder actions, special audit proceedings and the enforcement of and defense against claims of damages.
