The SEC issued long-awaited guidance on August 1, 2008 regarding the use of company websites as the sole means of disclosing information to investors. Companies with websites meeting the required criteria may post information solely to their websites rather than using newswire services or Form 8-Ks. The guidance also addresses liability for historical information, third-party hyperlinks, blogs and electronic forums and summary information. Read on for a summary of the guidance and practical steps to implement it.
