Antitrust enforcement in Europe is a considerable challenge for any successful American company. During the last decade, the European Commission in Brussels has been the destination for forum shoppers who have been unsuccessful before the US courts or agencies. Europe's flawed fact-finding and decision-making procedures mean that facts are decided without rigorous judicial review. During this presentation, Ian Forrester of the Brussels office of White & Case will review the problems of coping with European antitrust law in high technology matters, with particular reference to the recent Rambus case.
Mr. Forrester has argued many cases before the European Commission and the European Courts for clients such as Canon, Microsoft, Nintendo, Pfizer, Rambus, Toyota and the Liberal Democrat Party.

Mr. Forrester advises companies, as well as sovereign states and other governmental authorities, industry associations and private individuals, on European Union law, especially competition law, trade law, customs, internal market rules, intellectual property and constitutional rights in a variety of sectors, including information technology, software, broadcasting, chemicals, pharmaceuticals and sport.
He has been involved in a number of leading cases, including Magill, IMS and Microsoft (compulsory licensing), Bosman (transfer of professional football players), Syfait v. GlaxoSmithKline (parallel trade), Pfizer Animal Health (the precautionary principle) and A. v. National Blood Authority (whether blood transfusions causing hepatitis C were a "defective" "product").
Mr. Forrester's human rights cases include defending an investigative journalist, Hans-Martin Tillack, against attempts to reveal his sources, and a challenge under international law and the European Convention on Human Rights and Fundamental Freedoms to certain EU investigation procedures.
