Practice Experience
Ms. Asner is a commercial litigator with experience in class-action litigation, contractual disputes, domestic and international arbitration, litigation involving foreign sovereigns and their state-owned entities, litigation involving the Alien Tort Statute and other issues of public international law, RICO and securities litigation. She has trial and appellate experience in U.S. Federal and State courts and before arbitral tribunals. Ms. Asner also served as the Firm's global Administrative Partner from 2004 to 2007, overseeing administrative aspects of the Firm's 35 offices and helping to shape Firm culture, policies and strategic business objectives. Recent representations include:
PepsiCo in a False Claims Act lawsuit alleging that PepsiCo imported its soda concentrate under a false customs classification. Judgment was entered in PepsiCo's favor on all claims.
Comcast ABB Management Corp., the cable television provider, in a dispute with CSG Systems, a Colorado-based provider of billing and customer services to the cable industry, over a long-term contract between CSG and the former AT&T Broadband, which was purchased by Comcast in November 2002. After a five-week arbitration hearing, the arbitrator ruled in favor of Comcast ABB in October 2003, awarding the company $120 million in damages and approximately $400 million in pricing relief over the remaining term of the contract.
Arthur Andersen LLP in litigation matters related to the Internal Revenue Service's examination of Andersen's marketing of tax shelter products.
Citigroup in class actions relating to the activities of the bank in South Africa during the former apartheid regime, and J.P. Morgan Chase in class actions relating to a predecessor bank's alleged connections to African slavery in the United States prior to the Civil War.
Gotham Partners as a plaintiff in a derivative action in Delaware Chancery Court against a general partner in an action alleging breach of the governing limited partnership agreement and as a defendant in a federal securities lawsuit in the Southern District of New York. Gotham prevailed in the trials of both actions.
Magna International and its subsidiaries in New York Supreme Court, Commercial Division, in a dispute over a purchase price adjustment in connection with the sale of its ownership interest in an automotive joint venture.
The Republic of Poland and the Ministry of the Treasury of the Republic of Poland in federal class-action lawsuits relating to alleged real property expropriations after World War II.
Verizon in class action lawsuits filed in New York Supreme Court arising out of Verizon's provision of usage three-way calling services.
