Carine Piadé concentrates on litigation, with a focus on civil and commercial suits, white-collar and enforcement matters, in particular in relation to commercial contracts, and bankruptcy and insolvency proceedings. She represents a variety of clients including major French and international banks and financial institutions, and companies from a variety of sectors including the hotel, luxury goods, electronics, automotive and transport industries.

She has represented banks and their defeasance structures in complex litigation designed to limit bank losses and pursue the liability of the borrowing corporations or their managers, under both civil and criminal proceedings.

 

Carine has also represented banks and companies in white-collar crime proceedings involving the misuse of corporate funds, fraud and misleading advertising.

 

With respect to international commercial litigation involving rules of conflict, Carine has experience in applying foreign law rules.  She also has experience in litigation involving the enforcement of foreign and domestic judgments as well as other types of enforcement measures such as attachment of debt, seizure of assets, and impounding of aircraft.

Carine's experience includes:

  • Representation of an electronic components manufacturer and of a leading supplier of equipment and technologies in judicial expert proceedings with respect to potential liability actions;
  • Representing a major player in the rail industry with regard to breaches of contract and issues relating to fulfilments of contracts, including default of payment, default of delivery, liability, and evaluation of damages;
  • Representing several major hotel operators in litigation concerning post-acquisition issues, breach of negotiations, and breach of commissioning agreements;
  • Representing aircraft operators and leasing companies in bankruptcy matters;
  • Representing a leading French fashion publisher in various disputes involving shareholder and licensing rights;
  • Advising a consultancy company in relation to disputes concerning the management of another group;
  • Advising a major automotive manufacturer in commercial litigation and declaration of receivables against a bankrupt French company;
  • Advising a food ingredients and industrial bioproducts company on the acquisition of a food additive business including advising in relation to the patents and trademarks portfolio, which was one of the main assets of the target business; and
  • Advising two major oil companies in proceedings in France. These matters involved a high degree of cross-border judicial co-operation between France, Switzerland and other jurisdictions.
