Practice Experience
Elizabeth Oger-Gross is a member of the Firm's International Arbitration and Commercial Litigation Groups.
Elizabeth has assisted in the representation of clients in international arbitration and litigation. She has experience in actions involving commercial and investment disputes. She has been involved in arbitrations conducted under the rules of the International Chamber of Commerce (ICC), the American Arbitration Association (AAA), the United Nations Commission on International Trade Law (UNCITRAL), and the Swiss Chamber of Commerce.
Elizabeth also represents pro bono clients in immigration matters.
Her recent experience includes:
- Representation of a Middle Eastern developer in four related ICC arbitrations in Paris involving a dispute with a contractor concerning a major land remediation project in the Middle East, as well as ancillary court proceedings in the United States;
- Representation of a Canadian company in a Swiss Rules commercial-trade related arbitration, including complex issues of contract interpretation as well as European product safety law;
- Representation of a Middle Eastern group in an ICC arbitration, conducted in French, with an African state, in connection with public works contracts, as well as enforcement proceedings in numerous jurisdictions worldwide;
- Representation of BNP Paribas in a civil RICO claim filed by Kensington International Ltd in the federal court in New York. Kensington sought US$100 million in damages plus treble damages under the RICO statute;
- Representation of an Asian state in an investment dispute with a European construction consortium, pursuant to a bilateral investment treaty, arising out of the state's treatment of the company's investments in the host state;
- Advising a global oil company in relation to a suit brought against it in a UK court in connection with an environmental dispute in relation to its operations in a South American country;
- Advising a French bank in connection with complex issues of contract interpretation arising out competing contracts with a US financial institution and a North African bank;
- Representation of a French bank in connection with a request for discovery from a US court;
- Assistance in the representation of a Middle-Eastern state-owned oil company in relation to a dispute with a contractor;
- Advising on complex issues of contractual interpretation arising from the potential merger of two European cement companies;
- Advising the advisory board of a Russian company on the implications under New York law of a complaint alleging fraud against the Russian company and a US affiliate in connection with a sale of bonds;
- Advising a Japanese company in connection with a construction dispute with a publically-controlled entity in a Middle Eastern state;
- Assistance in representing a global company being investigated for antitrust violations in the United States and the European Union; and
- Advising two European banks on the jurisdictional consequences of selling unregistered securities to US institutional investors.
Prior to joining White & Case, Elizabeth was an intern with the Office of the United Nations High Commissioner for Human Rights in Geneva. She has also been an intern with the US government abroad and with the French government.
