Practice Experience
Ms. McDevitt practices in the area of general commercial litigation. She has extensive experience in the preparation and trial of complex commercial litigation in federal and state courts, and she has litigated cases in trial and appellate courts throughout the United States. Her clients come from a wide range of industries, including pharmaceuticals, banking (U.S. and international), insurance, agriculture and crop protection, and manufacturing.
Ms. McDevitt's relevant experience includes:
- Representing a major overseas bank in connection with one of the largest bankruptcy adversary proceedings ever filed in the U.S. (now pending in federal district court) alleging, inter alia, fraudulent conveyance, equitable subordination and aiding and abetting breaches of fiduciary duty.
- Representing an overseas air cargo carrier in connection with a major antitrust class action proceeding involving an alleged global price-fixing cartel.
- Representing a generic drug manufacturer in a number of State Attorney General suits alleging false claims act, common law fraud, RICO and consumer protection claims based on allegations that drug manufacturers reported inaccurate pricing benchmarks, which allegedly caused state Medicaid agencies to overpay for prescription drugs provided to Medicaid beneficiaries.
- Represented a leading pharmaceutical company in putative class actions involving claims under Title VII and the wage and hour laws respectively; obtained the dismissal of all claims against our clients in both matters on grounds of corporate separateness and plaintiffs' failure to justify piercing the corporate veil.
- Successfully represented a major pharmaceuticals manufacturer in a monopolization case involving allegations of fraud on the United States Patent and Trademark office.
- Represented a coalition of major health insurers in litigation against the tobacco industry; member of trial team in trial resulting in the first verdict against the tobacco industry by a third-party payer after a 10-week jury trial.
- Represented a major Swiss bank in lengthy litigations relating to the assets of Ferdinand Marcos, which implicated complex issues of international comity, the Act of State doctrine and post-judgment execution laws.
Ms. McDevitt also has devoted substantial time and energies to pro bono capital representation throughout the course of her career, and recently led the challenges to Alabama's method of execution by lethal injection. She is a two-time recipient of the Thurgood Marshall Award, awarded by the Association of the Bar of the City of New York, in connection with such pro bono capital defense work.
