Practice Experience
Ivo Janda focuses on the law of the European Communities, dispute resolution, insolvency law, competition law, and other regulatory issues, such as data protection. Mr. Janda joined the Prague Office of White & Case in 2001. Among others, Mr. Janda leads the Prague office's EU Law Practice Group.
Former Practice Prior to joining White & Case, Mr. Janda worked for the International Law Department of the Ministry of Foreign Affairs of the Czech Republic, where he was involved in drafting legislation and reviewing numerous acts, with an emphasis on implementing obligations of the Czech Republic arising from EC legislation and international treaties. Mr. Janda also provided legal assistance to individual government departments, as well as to the private sector, regarding international law and EC law, and he participated in the Czech delegations in intergovernmental negotiations on property interests of the Czech Republic abroad. Further, Mr. Janda was delegated by the Ministry of Foreign Affairs as a legal advisor to the Permanent Mission of the Czech Republic to the UN in New York, and he represented the Czech government in all legal commissions of the United Nations focusing on international trade law, finance law, and international intellectual property law.
EU Law, Competition Law and Other Regulatory Practice Mr. Janda has recently been involved with the White & Case team advising major Czech banks in negotiations with Czech state agencies and the European Commission in connection with reviewing state aid granted by the state to the Czech banking sector prior to the accession of the CR to the EU. Further, Mr. Janda prepares analyses on EC tax law, EU structural fund drawdown rules, and the implementation of PPP projects. He commonly advises clients on a broad range of competition-law issues.
Mr. Janda is representing the Association of Innovative Pharmaceutical Industries (formerly the International Association of Pharmaceutical Companies - MAFS). His assistance has mainly concerned the legislative process of the Health Insurance Act, as well as representation before the European Commission in the context of an infringement procedure launched against the Czech Republic according to Article 226 of the EC Treaty in respect of the Czech regulatory scheme for the reimbursement of medicinal products.
Dispute Resolution Practice Mr. Janda was a member of the White & Case team representing a major Czech bank, Československá obchodní banka, before the International Center for the Settlement of Investment Disputes in Washington D.C. in the case of ČSOB vs. Slovak Republic. In addition, Mr. Janda advises various companies on their commercial disputes before domestic courts, the EC courts and in international arbitration.
Mr. Janda has further represented Toshiba Corporation before the Czech Office for the Protection of Competition and before the Czech courts in proceedings related to a cartel investigation. Also, Mr. Janda is currently representing Unipetrol in a related case pending before the Court of First Instance of the European Union.
