Practice Experience
John Cunningham is a partner in the Firm's Financial Restructuring and Insolvency Group. Mr. Cunningham regularly appears nationwide in corporate bankruptcy matters and workouts on behalf of troubled companies, creditors' committees, bondholders, trade creditors, financial institutions, lenders and strategic investors.
Mr. Cunningham is counsel to Major League Baseball in the Chapter 11 cases of Los Angeles Dodgers, LLC et al. in Wilmington, Delaware. Mr. Cunningham also currently represents the first lien noteholders in the restructuring of Independencia, SA (a Brazilian beef producer), and the second lien lenders in the restructuring of Neways (a multi-level marketing company). Recent representations include the Ad Hoc Group of Noteholders in the Chapter 11 cases of Six Flags, Inc., et al. (Wilmington, DE), the Ad Hoc Group of Senior Secured Noteholders in the Chapter 11 cases of Solutia, Inc. (New York); the Official Committee of Unsecured Creditors in the Chapter 11 cases of Chem Rx (Wilmington, DE), International Aluminum Corp. (Wilmington, DE), the IT Group, Inc. (Wilmington, DE), Venturelink Holdings, Inc., (Dallas, TX), Quality Stores, Inc. (Grand Rapids, MI), and the Official Committee of Excel Independent Representatives in the Chapter 11 case of VarTec Telecom, Inc. (Dallas, TX).
Other representations also include a public power equipment manufacturer in its Chapter 11 case in Wilmington, DE; a public automotive equipment manufacturer in its Chapter 11 case in Detroit, MI; one of the largest Mexican paper companies in its reorganization in Mexico and the U.S.; a Dominican Republic company in the restructuring of one of its portfolio companies (one of the largest telecommunications providers in the Dominican Republic); a bank syndicate in the restructuring of a public pharmaceuticals company; a nationwide retailer of cellular and wireless products in the successful sale of its business in Chapter 11; an official bondholders committee in the Chapter 11 case of one of the largest casinos in the United States; an ad hoc bondholders committee in the restructuring of an international logistics company.
