Issue: Minnkota Power Cooperative (MPC), a transmission provider, self-reported on October 13, 2010 that it did not have procedures in its Open Access Transmission Tariff (OATT) for the use of Capacity Benefit Margin (CBM) in violation of R1 and thus had no procedures posted to a website, in violation of R2. MPC updated its tariff on September 26, 2010 to explain that it does not set aside CBM and provided the procedures should it decide to set aside CBM in the future. MPC posted its tariff to include procedures on the use of CBM on October 4, 2010.

Finding: MRO determined that this violation posed a minimal risk to the reliability of the bulk power system because MPC does not have any Network Customers under its OATT, therefore there would be no requests for CBM.
