GOP Group Challenges Policy on Gays in the Military

In a federal court in Riverside, CA, the US Defense Department’s long-standing "don't ask, don't tell" policy with respect to gays in the military is now facing a constitutional challenge brought by a Republican gay rights group frustrated with the Obama administration's failure to repeal the law.

If the Log Cabin Republicans win their case, their lawyer says he will ask a federal judge to do what President Obama has so far failed to do — halt the policy immediately nationwide.

"We're trying to get this changed right away. After all, there are people today fighting, dying for our country, while their constitutional rights are being violated," said attorney Dan Woods, representing the national organization whose 19,000 members include current and former military members.

Woods, a Los Angeles attorney from the firm White & Case, said he wants a federal injunction. If that happens and the government appeals, Woods said he will ask Phillips to suspend the policy until the case is decided.
