In this podcast, Ken Raskin, head of White & Case's Global Executive Compensation, Benefits and Employment Law Practice, discusses the implications of the recent US Supreme Court case Larue v DeWolff, Boberg & Associates Inc. et al., which allows an employee to sue for losses resulting from a 401(k) pension plan. Raskin is not surprised by the ruling and feels similar litigation is likely to follow, since it is an easier route for an individual to get compensation than by filing a class action lawsuit and because the ruling has forced the federal government to consider changes to ERISA.
