Court Narrows US Money Laundering Law
June 3, 2008, The Financial Times
The Financial Times featured an article on two recent cases where the Supreme Court overturned convictions, which may narrow how money laundering statutes are applied in the future. In one case, the court ruled that a person attempting to conceal money while transporting it was not sufficient evidence and in the other, it stated "money laundering statutes did not apply to payments to employees."
"These two cases may signal that the court is going to breathe new life into the idea that you should not hold a defendant accountable, or punish them, [based on] a standard that is ambiguous or unclear," said George Terwilliger, global head of the White Collar Practice at White & Case.
