This summer, the Federal Circuit Court of Appeals will hear oral arguments in a lawsuit against Microsoft Corp. that has been described as "one of the important legal battles of the modern era." Lucent Technologies, Inc. v. Gateway, Inc. promises to dramatically alter the framework for assessing patent damages and to address one of the most hotly contested issues in the Patent Reform Act wending its way through Congress. Is an infringer's liability limited to the value of the specific features or components found to infringe? Or, must it pay damages based on the market value of the entire product? The difference could mean hundreds of millions of dollars of exposure for a company caught on the wrong side of a patent dispute.
In this CLE, we will provide an overview of patent damages law, explain damages apportionment, discuss the most recent case law regarding the entire market value rule, summarize the Federal Circuit hearing in the Lucent matter and discuss what the outcome of Lucent could mean for your company.

Mark F.
