Danuta Świątek is a legal advisor in the Dispute Resolution practice. She focuses on insurance law issues from both the regulatory and civil procedure perspective. She advises insurance companies on the legitimacy of insurance claims raised by insured parties under various insurance contracts (D&O, PI, and property) and recourse claims of insurers, and also represents insurance companies in liquidation proceedings and court proceedings concerning insurance claims. She has extensive experience in preparing opinions on the compliance of insurance products with Polish law, in particular concerning consumer protection requirements. She has participated in the restructuring of branches of foreign insurance companies and advised insurers on the outsourcing of insurance services, cross-border transfers of insurance portfolios, the sale of insurance receivables and insurance secrets.
Her experience includes representing companies and shareholders in corporate disputes, the pursuit of claims in bankruptcy proceedings and representing employers in disputes with employees.
Advising a French insurance company regarding the effect of the restructuring of its capital group on the insurer’s Polish branches and the scope of conditions for transferring an insurance portfolio between companies from the group
