White & Case Seminar: Greenhouse Gas Regulation and Litigation in the US and Abroad – Implications for the Oil and Gas and Power Generation Industries

Over the past few years, power producers and the oil and gas industry have been under pressure due to increased regulation designed to reduce carbon dioxide and other greenhouse gas (GHG) emissions. At the same time, these industries have been confronted with litigation in the US based on theories of public nuisance brought by states, NGOs and the tort bar seeking to recover damages for, or injunctive relief requiring the reduction of, GHG emissions. Lawyers from the White & Case International Environmental and Climate Change practice groups, who have filed briefs in two of the major climate change cases, will discuss these developments and the outlook for affected industries.

The presentation will focus first on Connecticut v. American Electric Power, currently pending before the Supreme Court, concerning whether federal courts should establish limits on GHG emissions of the power industry and petroleum refiners. We will also provide an update on other climate change cases in which the plaintiffs have sought hundreds of millions of dollars in damages and the implications of these cases for GHG-emitting industries. We will then discuss the status of existing and proposed federal regulations restricting GHG emissions and their expected impact on power suppliers and the oil and gas industry. In addition, we will review initiatives on the regional and state level, including California's embattled cap and trade program.

A representative from our Brussels office will then lead a discussion on legislative efforts to limit GHG emissions in Europe, addressing such issues as GHG regulation of the petroleum, cement and power generation industries, the EU Emission Trading Scheme, Cap and Trade System and the status of carbon and energy tax directives. Discussion will focus not only on how these regulatory initiatives may affect various industries in Europe, but also on how these regulatory programs may influence possible future US legislation.
