Practice Experience
Daniel Garton is an associate in the London office, practising in the International Arbitration and Construction and Engineering Groups. He advises on both contentious and noncontentious construction work. He has advised upon a multitude of purpose-drafted and standard form construction contracts including EPC, EPCM, DBOM and traditional lump sum construct-only contracts across a variety of industries including infrastructure, power, mining and building. He has particular experience in the energy and resources arena. Daniel joined White & Case in 2006 from a leading Australian law firm. Examples of recent representations include:
Dispute resolution experience
- Advising in respect of the design and construction of nuclear power stations;
- Representing a major Saudi Arabian company in an ICC arbitration under Saudi Arabian law relating to the construction of an international hotel and mixed use development (FIDIC contract);
- Acting for and advising one of Australia's largest energy infrastructure companies in relation to a dispute over tariff arrangements applicable to one of its gas pipeline assets, regulated under both State and Federal regimes;
- Acting for a coal mining joint venture partner in a joint venture dispute over the split of royalties from the joint venture assets; and
- Advising a large property development company in relation to a dispute with its construction contractor over the construction of Queensland's tallest commercial and residential building.
Project development experience
- Representing the project company on the construction aspects of the development and project financing of the Nord Stream Baltic pipeline, which runs from Russia to Germany through the Baltic Sea and the exclusive economic zones of Russia, Finland, Sweden, Denmark and Germany;
- Acting for a wholly-owned government company, negotiating and drafting US$2 to US$3 billion (est.) planning, design, build, operate and maintain contracts for a rapid rail system in Trinidad;
- Advising the project sponsors on principal contracts, including the negotiation of finance arrangements for one of the largest alumina processing facilities in the world. The US$2.8 billion project comprises a bauxite mine, a railroad, port facilities, a captive coal-fired power station and an alumina refinery;
- Acting for the project sponsors in relation to the financing and construction of a US$800 million 3500 MPTD Ammonia/Urea complex in Algeria including drafting the FEED and EPC contract for release to tenderers and assisting in negotiations with the bidders;
- Advising the Abu Dhabi Water & Electricity Authority (ADWEA) on all construction aspects in connection with its seventh independent water and power producer (IWPP) project involving development of a US$2.8 billion greenfield 2,000 MW and 130 MIGD power generation and seawater desalination plant and associated facilities in the Emirate of Fujairah; and
- Negotiating and drafting numerous multi-million dollar supply and construction contracts for an AUS$800 million expansion of a coal port.
