Practice Experience
Ms. Burke is a member of White & Case's Global Competition and Commercial Litigation Practice Groups. She concentrates on complex commercial litigation and counseling in the areas of intellectual property, antitrust and trade regulation.
Representative cases include the following:
- Successfully defended leading pharmaceutical company in preliminary injunction proceedings challenging FDA approval of a complex drug.
- Secured a jury verdict in favor of Experian Information Solutions, Inc. in Fair Isaac Corporation v. Equifax, et. al., an action brought by FICO, the dominant provider of consumer credit risk scoring services, against the three major U.S. credit bureaus alleging trademark infringement and unfair competition in the sale of credit scoring services. The jury also found in favor of Experian on its counterclaim that FICO committed fraud on the U. S. Patent and Trademark Office in procuring registration of the trademark in suit.
- Represented Experian Information Solutions, Inc. and obtained dismissal of all federal and state antitrust and false advertising claims on summary judgment in an action brought by FICO against the three major U.S. credit reporting agencies and their joint venture, VantageScore.
- Advised the American Society of Composers, Authors and Publishers (ASCAP) regarding online music royalty rates for determining reasonable license fees to be paid by AOL, RealNetworks and Yahoo! for the right to perform millions of musical works created and owned by ASCAP's songwriter, composer and music publisher members.
- Advised a leading pharmaceutical company and a leading bread manufacturer regarding antitrust implications of their respective potential acquisitions.
- Assisted a global manufacturing company in a worldwide internal Foreign Corrupt Practices Act investigation.
As part of her pro bono efforts, Ms. Burke participated in the Firm's externship program with inMotion, Inc., where she represented and counseled low-income women who were victims of domestic violence in matrimonial and family law matters. During the three month externship, Ms. Burke served as lead counsel on numerous cases and appeared in various courts multiple times a week. In addition, Ms. Burke has also represented Acumen Fund, a non-profit global venture fund, in a breach of contract and default judgment case before the New York Supreme Court, and advised the World Society for the Protection of Animals regarding animal welfare laws in the United States.
Ms. Burke has also given a number of presentations to the Firm's Antitrust and Intellectual Property Groups on a variety of topics including copyright concerns with respect to virtual worlds, royalty rates for online radio and the revised 2010 Horizontal Merger Guidelines.
