Practice Experience
Kirsti Massie is an associate based in the London office of White & Case. Kirsti specialises in energy projects, with particular expertise in energy and emissions trading and renewable projects.
Much of Kirsti’s experience has been gained in-house working in large international energy companies. Her experience includes advising project sponsors, developers and financial institutions on all aspects of project development for both new build and existing energy projects in various jurisdictions around the world, UK and European energy and emissions trading, trading credit support arrangements, fuel supply arrangements, power offtake arrangements, tolling agreements, applicable regulatory provisions, project finance and debt re-structuring. Kirsti also has considerable experience in the field of renewable projects including wind farm and biofuel developments.
Representative Experience includes:
Advising various renewable generators in respect of the sale of power, renewable obligation certificates and other “green” credits in the UK and Ireland;
Representation of a renewable generator in the portfolio financing of a variety of wind farm assets and development sites in the UK;
Representation of a developer on the acquisition of a wind farm development site in the UK and associated arrangements;
Advising project sponsor in respect of a tolling agreement for a new build gas-fired plant in the Netherlands;
Advising major utility in respect of various master agreements for the trading of various energy commodities (including power, gas, carbon, sulphur, coal and renewable obligation certificates) in the UK and Europe;
Advising major utility on the provisions of an Emission Reduction Purchase Agreement and associated credit support arrangements;
Representation of major utility in respect of gas and power offtake agreements and associated direct agreements following asset sale;
Advising major utility on the acquisition of a CHP plant and associate power and steam offtake arrangements;
Representation of project sponsor of new build biomass project in negotiation and agreement of power offtake agreements and biomass supply arrangements;
Advising financial institution in respect of proposed investment in UK biofuels development project;
Advising an oil & gas producer on gas sales agreements and transportation arrangements in various former Soviet Union states;
Undertaking detailed due diligence for the purchaser of 100% equity in a portfolio project finance infrastructure project;
Advising a number of energy sector participants on energy and emissions trading documentation and credit support arrangements;
Providing advice on the UK and EU Emissions Trading Schemes, including provisions applicable to New Entrant Reserve and Kyoto project mechanisms;
Advising Rugeley Power Limited on debt re-structuring and tolling agreement provisions for 1000 MW coal-fired Rugeley power station;
Advising major international energy company on its UK fuel supply arrangements;
Advising International Power plc in relation to the establishment of its UK energy trading business.
