Practice Experience
Lupus Sabene has recently returned to White & Case from a secondment at Mitsubishi Corporation where he divided his time assisting the energy and machinery business divisions. Prior to joining the White & Case Tokyo office, Lupus was an associate in our London office where he was a member of the Construction & Engineering Practice.

His practice focuses on project finance, project development and construction, especially in the areas of energy, infrastructure and transportation. He also has experience in dispute resolution in relation to construction projects in the oil and gas, process plant and commercial property sectors.

His recent experience includes:

Energy
  • Currently assisting Japanese utilities on a number of long term LNG supply arrangements.
  • Advising Mitsubishi Corporation on its contractual partnering and successful bid to participate in heavy oil extraction ventures in certain blocks of the Carabobo concession area in Venezuela.
  • Assisted a major Japanese trading house with its entry into the shale gas market in North America. This included participation in negotiations, due diligence and documentation in connection with a number of partnering and joint venture arrangements as well as proposed acquisitions in major shale gas plays in the US and Canada.

Power
  • Advising on a number of transmission asset purchases in India, the UK and Germany.
  • Assisting a major Japanese trading house with its proposed purchase of an ownership interest in a US$10 billion nuclear power project being developed in the state of Virginia, USA.
  • Advising on EPC/LTSA contractor bids for numerous power projects including EGAT's Chana 2 and Wang Noi 4 projects, the Rabigh Power Plant Stage I FGD Retrofit and the Qurrayah IPP Project.

Other Project Experience
  • Representing a multilateral lending agency in relation to a US$360 million limited recourse financing of a methanol project in Brunei.
  • Acting for the project sponsors on a US$2.5 billion alumina refinery and associated port, mine, railway, town and captive power plant in Guinea. Assisting with the drafting of the project documents and negotiations with contractors.

Equipment Finance/Leasing Experience
  • Assisting Mitsubishi Corporation's Shipping unit with a number of transactions including ship financings, construction contracts and contentious matters.
  • Acting with respect to the acquisition and financing of a 50 percent interest in a US$700 million drillship built exclusively for the exploration and development of Petrobras' deep-sea oil and gas fields in Brazil and abroad.
  • Assisting lenders in negotiating a finance package for a fleet of mining trucks in Latin America.
  • Acting for lenders and lessors in connection with a number of Japanese operating lease transactions.

Arbitration/Claims Experience
  • Acting on behalf of a leading international Korean contractor on claims and counterclaims worth in excess of US$1 billion in an ICC Arbitration, in Spanish, relating to a US$2 billion oil refinery and onshore pipeline project in Mexico.
  • Representation of a US oil company (as defendant) in a US$200 million UNCITRAL arbitration, under Indonesian law, relating to the construction of offshore oil and gas facilities in Indonesia.
  • Assisting in the representation of major Saudi Arabian company in an ICC arbitration, under Saudi Arabian law, relating to the construction of an international hotel and mixed use development (FIDIC contract).
