Practice Experience
Ladislav Smejkal concentrates on employment law, corporate law and criminal law, with an emphasis on white collar crime.

Employment, Labor Law and Business Immigration
Mr. Smejkal is the head of the local Employment Law Practice Group, and coordinates our employment and labor law advice in the CEE/CIS region. Mr. Smejkal provides both contentious and noncontentious employment law advice in a wide variety of contexts, with an emphasis on corporate-related employment issues.

Examples of recent representations in matters: 
  • Celestica in connection with the hiring-out of labor, restructuring, downsizing, collective redundancies and the transfer of employees, including the preparation of internal documentation; 
  • CN Worldwide in connection with shutting down its European operations, including its local branch in the Czech Republic; 
  • Eurohypo in connection with the closure of its local presence and related employment law issues; 
  • GE Real Estate on everyday legal advice in employment law in connection with their activities in the CEE region, including issues related to downsizing, benefits, employer liability for damage, employees on maternity leave and parental leave, and avoiding discrimination; 
  • JTEKT in connection with the acquisition (share deal) of a local factory and related collective bargaining of a new collective agreement; 
  • Jihomoravska armaturka spol. s r.o. on employment law issues related to a merger, collective bargaining and a collective agreement, the rights of union members, and issues in connection with downsizing; 
  • Johnson Controls in connection with the implementation of a global internal compliance policy, selected issues of employees to be dismissed, and the transfer of employees; 
  • Koch – Invista, a US-based global oil and gas company, in connection with shutting down one of its divisions in Europe, including the Czech Republic and Russia, in particular, with related downsizing and relocation to Italy and devising a new remuneration scheme for remaining senior employees; 
  • Radio Free Europe/Radio Liberty on everyday legal advice in employment and labor law, including the preparation of a new collective agreement and a set of internal documents, including internal policies and contracts, data protection issues, employee litigation, avoiding discrimination, and employee liability for damage; 
  • Stafford Group in connection with collective redundancies linked to shutting down its local presence and the subsequent liquidation of a retail chain in the Czech Republic; 
  • T-Mobile/ T-Systems in connection with the negotiation of a settlement with one of its top senior managers working at the regional level; 
  • Visteon Autopal s.r.o. in connection with avoiding discrimination and a collective bargaining agreement.

Corporate Law
Mr. Smejkal is a member of the Corporate Practice Group, and his experience includes advising on the following matters and transactions: 
  • Bureau Veritas in connection with the acquisition of a business interest in the Czech company AF-Qualitest s.r.o.; 
  • Celestica in connection with the closure of its Rajecko site and the transfer of its assets to Tyco; 
  • Jung von Matt, a major advertising provider in Germany, in connection with the acquisition of a majority stake in kaspen, a.s.; 
  • Nordic Capital in connection with the transfer of the ConvaTec division as a going concern from Bristol-Myers-Squib.

Criminal Law (White Collar)
Mr. Smejkal is a senior member of our White Collar practice, and he concentrates on representing clients as injured parties in criminal proceedings and on the criminal liability of top managers.

Examples of recent representations in matters: 
  • Representing the injured party in criminal proceedings regarding the loss of state funds from the company GALILEO REAL, k.s.; 
  • Advising various bank clients regarding possible criminal law consequences of the activities of the banks' debtors in insolvency; 
  • Advising two major US-headquartered automotive producers with local presence extorted by their sub-contractors; 
  • Advising a client, a local manufacturing company, in connection with the fraudulent activities of its key sales person; 
  • Analysis of the potential criminal law liability of a client's top management in the case of contemplated business activities in the Czech Republic; 
  • Analysis of the potential criminal law liability of a client's top management in the case of an injury resulting in death at its factory.
