Practice Experience
Michael Kerstetter is an associate in the Energy, Infrastructure, Project Finance and Asset Finance group of White & Case with experience in cross-border project financings, public-private partnerships (PPPs), climate change matters, and cross-border M&A transactions. Mr. Kerstetter has been involved in transactions in the United States, as well as abroad, primarily in the Middle East and North Africa.
Among others, Mr. Kerstetter has represented:
Abu Dhabi Water & Electricity Authority (ADWEA) in connection with its eighth independent water and power producer (IWPP) project, the Shuweihat S2 IWPP project, involving the development of a greenfield 1,500 megawatt (MW) and 100 million imperial gallons daily (MIGD) power generation and seawater desalination plant and associated facilities in the Emirate of Abu Dhabi in the United Arab Emirates (UAE);
Municipality of Jeddah, Kingdom of Saudi Arabia and its special purpose entity created by Royal Decree in connection with the expansion and modernization of Jeddah’s city center and implementation of several PPP projects to revitalize the central business district, remediate the Jeddah waterfront, and the development of new municipal infrastructure on a build-own-operate-transfer (BOOT) basis;
Municipality of Jeddah, Kingdom of Saudi Arabia in connection with a landfill gas project in Jeddah, to be engineered, built, and managed on a BOOT basis for eventual registration under the Clean Development Mechanism (CDM) and the production of Certified Emission Reductions (CERs);
Abu Dhabi Investment Company in connection with its acquisition of Orasinvest Holding from Orascom Telecom including its subsidiaries in Algeria, Bangladesh, Egypt, the Kingdom of Saudi Arabia, Pakistan, Tunisia and the UAE;
A Deutsche Bank infrastructure investment fund in its US$2 billion acquisition of Maher Terminals in the ports of New York and New Jersey;
Saudi Arabian Oil Company (Saudi Aramco) in its multi-billion dollar joint venture development of an export petroleum refinery in Yanbu, Saudi Arabia;
BNP Paribas as arranger for a project financing of two 115 million gallon ethanol facilities in Nebraska and Minnesota owned by BioFuel Energy; and
Saudi Aramco and its affiliates in connection with a planned 325,000 barrel-per-day expansion of a refinery in the southern United States.
Mr. Kerstetter spent more than a year in Abu Dhabi, the United Arab Emirates to help establish the firm’s office, which opened in December 2007, before returning to the New York office.
