Practice Experience
Mr. Carberry practices in the area of complex commercial litigation. He has extensive experience representing and advising clients in connection with litigation and arbitration involving commercial disputes, securities fraud, antitrust, RICO and fraud, multi-forum and complex litigation, bankruptcy and class actions. His clients represent a wide variety of industries, including banking and financial services (U.S. and international), energy, health insurance, pharmaceuticals, agriculture and manufacturing.
Mr. Carberry's relevant recent experience includes:
Representing a major foreign bank in connection with one of the largest securities fraud class actions ever filed in the U.S. and a concomitant bankruptcy adversary proceeding involving the same allegations;
Prevailing on a motion to dismiss on behalf of a Lebanese construction firm in connection with an action filed in Delaware federal court seeking a preliminary injunction to enjoin an international arbitration proceeding abroad;
Representing one of the largest publicly traded health insurance companies in connection with a commercial arbitration arising out of its acquisition of certain business segments from another health insurer;
Defending civil RICO claims brought in Massachusetts federal court against a Russian businessman by various business partners in connection with the acquisition of a Ukrainian mining interest.
Representing a major U.S. bank and financial services company in connection with one of the largest bankruptcy adversary proceedings ever filed in the U.S. alleging inter alia RICO, unjust enrichment, equitable subordination and aiding and abetting violations of fiduciary duty;
Prevailing on a motion to dismiss on behalf of a national financial services company in connection with multidistrict litigation brought by the descendents of African-American slaves seeking restitution from various businesses for the institution of slavery;
Representing a major agricultural crop protection manufacturer in connection with an antitrust action in which it was named an unindicted co-conspirator and a related government inquiry; and
Participating as a member of the trial team in a 10-week jury trial in an action brought on behalf of a coalition of health insurers seeking damages for costs incurred in treating smoking-related illnesses which resulted in the first ever jury verdict by a third-party payer against the tobacco industry.
